DJR García attorneys Deborah Rotenberg and Lauren Barker will be presenting “Navigating Compliance with Substance Use Disorder Records Laws” at the virtual Health Center Compliance Symposium on March 11th. Providers with substance use disorder (“SUD”) treatment programs participating in a Health Information Exchange (“HIE”) face a thicket of complex legal and regulatory requirements for the protection and sharing of patient SUD records. These competing demands are thanks to the dual legislative policies prioritizing patient privacy and ensuring productive exchange of health information that create often-contradictory demands on providers. This presentation will provide background on the relevant legal frameworks, the current legal uncertainties, and strategies to achieve workable compliance in an environment where perfect compliance may not be possible.
